# Service terms

## The service

We provide hosted inference for the models enabled in our catalog. You open a connection, send observations in the supported format and receive action predictions. We operate the inference service and compute. You remain responsible for your application, observations, controllers and any use of predictions.

This initial service is for development and simulation. We have not qualified a physical-robot integration. Predictions are not a safety system or a guarantee of task success. Do not connect them to physical actuation without separate integration validation, local safety controls and appropriate supervision. An API disconnect, revoked key or account deletion is not an emergency stop.

You must have legal capacity to enter into these terms and authority to bind any organization for which you use the service. Keep credentials secure, use only data you have the right to process, and do not interfere with other customers, evade limits or abuse promotional credits.

## Inference charges and credits

The catalog and session confirmation show the model's price per 1,000 completed requests and its rate version. A billable request is an action response written to your connection within the service deadline. A completed server write does not prove that your robot received or executed it; your controller must check freshness before use.

We do not charge for model loading, warm-up, waiting for capacity, idle time, rejected or expired observations, failed requests, late results or cleanup. Requests that run but finish too late may count toward a request limit without being charged. Your session spending cap limits its charge; a temporary balance reservation is released or settled when the session closes. If a worker disappears, settlement uses its last reported completed-request count, within the cap; without a report, no inference charge is applied.

Promotional credits, including the eligible-account $5 trial, are spent before purchased credits. Trial eligibility is limited to one person; repeated accounts do not create a new entitlement. Purchase amounts and any applicable taxes are displayed before checkout. Credits have no cash or transfer value. **Unused promotional and purchased credits are nonrefundable, except where applicable law requires otherwise.** This policy does not remove rights concerning incorrect charges or payments. Contact support to report a billing error.

Refunds and disputes reverse the associated credit and may close sessions that are no longer covered. Deleting your account requires acknowledgment that unused credit will be forfeited after sessions and payments are reconciled. A payment completing during deletion is reviewed separately and does not restore account access. Payment processing is provided through Stripe and its applicable checkout terms.

## Availability and changes

Workers start on demand and may be shared. A listed model does not promise an already loaded GPU, immediate capacity, unlimited concurrency, a fixed startup time or an uptime guarantee. Startup can fail or take longer than usual; the SDK exposes status and timeouts. Closing the last connection allows a worker to stop. Capacity limits and model availability can change.

Support is **best-effort email support with no guaranteed response time**. The [support page](https://yellowandblack.dev/docs/support.md) explains contact and status information. There is no 24/7 staffed support promise.

New prices have a new rate version; admitted sessions retain their admitted rate. Clients may require an expected rate version. Material changes to these terms receive a new version, and new sessions require the account holder to accept that version. We may suspend access to address abuse, unpaid or reversed balances, security incidents, legal requirements or violations of these terms. You may stop using the service and request account deletion.

## Model terms and permitted use

The π0.5 models include Gemma components. Their use through this service is subject to the **Gemma Terms of Use, updated April 1, 2026**, supplied in full on our [Gemma terms page](https://yellowandblack.dev/docs/gemma-terms-2026.md). The [model notices](https://yellowandblack.dev/docs/model-notices.md) also provide the Gemma text bundled with the pinned OpenPI release and the OpenPI license.

As an enforceable condition of these service terms, **you must not use Gemma or its derivatives for uses prohibited by the [Gemma Prohibited Use Policy](https://ai.google.dev/gemma/prohibited_use_policy), incorporated here by reference, or in violation of applicable laws and regulations**. A [retained copy of that policy](https://yellowandblack.dev/docs/gemma-use-policy.md) is supplied for reference. These restrictions apply to the Gemma-derived functionality made available through this API. We may suspend or terminate use that violates them. Our terms do not replace or narrow the publisher's applicable restrictions and do not imply endorsement by Google or Physical Intelligence.

You must comply with applicable sanctions and export restrictions. Access to the service does not grant ownership of model weights or permission to redistribute them. You retain rights you already hold in your inputs; we process them to provide, protect and support the service as described in the [privacy notice](https://yellowandblack.dev/docs/privacy.md).

## Data and deletion

The privacy notice explains stored information, providers, retention and account controls. Modal Functions may retain inference inputs and outputs for up to seven days even when our diagnostic capture is disabled. Do not submit data that requires a retention or confidentiality guarantee this service has not agreed to provide.

Account deletion disables access first, then reconciles open work and performs asynchronous cleanup. It does not immediately erase provider copies, historical backups or retained financial, security and trial-eligibility records.

## Warranties and responsibility

To the extent permitted by applicable law, the service and predictions are provided as available, without warranties of accuracy, fitness for a particular task, uninterrupted availability or non-infringement. To that extent, the operator is not liable for indirect or consequential losses, lost profit or lost data arising from use of the service. The operator's aggregate liability arising from the service is limited to the greater of $100 or the service fees you paid in the preceding three months. These limits do not exclude liability or rights that applicable law does not allow to be excluded or limited, or liability for fraud or intentional misconduct.

Virginia law governs these service terms, subject to mandatory protections that apply to you. This choice does not change the governing law of third-party model terms. Nothing here requires arbitration or waives a right that cannot lawfully be waived.
